Terms of Use

1. Scope and Acceptance

These Terms of Use ("Terms") govern your use of all software applications, websites, and services (collectively "Services") provided by treeinspired GmbH, Switzerland ("treeinspired", "we", "us"). By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use our software applications for their intended purpose on devices you own or control. This license does not include the right to:

• Copy, modify, distribute, sell, or sublicense the software
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any proprietary notices, labels, or marks
• Use the software for any unlawful purpose
• Use the software to develop competing products

3. Beta Software

Software marked as "Beta" is provided for testing purposes. Beta software may contain bugs, errors, and incomplete features. Beta licenses are time-limited and expire automatically. We reserve the right to discontinue beta programs at any time without notice. Beta software is provided strictly "as is" without any warranty whatsoever.

4. Intellectual Property

All intellectual property rights in our Services, including but not limited to software code, design, graphics, logos, trademarks, documentation, and content, are and remain the exclusive property of treeinspired GmbH. Nothing in these Terms transfers any intellectual property rights to you.

5. User Obligations

You agree to:

• Use our Services only in compliance with applicable laws and regulations
• Not use our Services to intercept, monitor, or record communications of third parties without their consent where required by law
• Not use our Services for unauthorized penetration testing, hacking, or any illegal activity
• Not attempt to circumvent license restrictions, beta expiration mechanisms, or security measures
• Not use our Services in any manner that could damage, disable, or impair our infrastructure

6. ProxyButler — Specific Terms

ProxyButler is a network debugging tool intended for legitimate software development, security testing, and network diagnostics. You are solely responsible for ensuring that your use of ProxyButler complies with all applicable laws, including but not limited to data protection laws, telecommunications laws, and computer fraud statutes. Intercepting network traffic of third parties without authorization may be illegal in your jurisdiction.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Services will be uninterrupted, error-free, secure, or free of viruses
• Warranties regarding the accuracy, completeness, or reliability of any content, data, or information provided through the Services

Medical applications (Kompendium, Dockti, ICD-10) are intended as informational tools only and do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TREEINSPIRED GMBH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Business interruption or downtime
• Cost of procurement of substitute goods or services
• Damages arising from unauthorized access to or alteration of your data
• Any other intangible losses

In no event shall our total aggregate liability exceed the amount you have actually paid to treeinspired GmbH for the specific Service giving rise to the claim in the twelve (12) months preceding the event, or CHF 100, whichever is greater.

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless treeinspired GmbH and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party rights.

10. Payment and Refunds

All purchases and subscriptions for our applications are processed exclusively through third-party platforms (Apple App Store, Google Play Store). treeinspired GmbH does not process payments directly and cannot issue refunds.

If you wish to request a refund, you must contact the platform through which you made the purchase:

• Apple App Store: Request a refund at reportaproblem.apple.com. Apple's refund policy allows requests within 14 days of purchase. For details, see Apple's refund support page.
• Google Play Store: Request a refund through Google Play order history. Google generally allows refund requests within 48 hours of purchase, or up to 14 days in the EU. For details, see Google Play's refund policy.

Refund eligibility, processing times, and conditions are determined solely by the respective platform. treeinspired GmbH has no control over refund decisions made by Apple or Google.

General payment terms:

• All prices are displayed in the currency of your App Store/Play Store region and include applicable taxes as determined by the platform
• Subscriptions renew automatically unless cancelled before the end of the current period through the respective platform's subscription management
• We reserve the right to change prices at any time. Price changes for active subscriptions take effect at the next renewal

11. Termination

We may suspend or terminate your access to our Services immediately and without prior notice if you violate these Terms. Upon termination, your license to use the software is immediately revoked. You must destroy all copies of the software in your possession. Sections 4, 7, 8, 9, and 13 survive termination.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through our Services or website at least 30 days before they take effect. Continued use of our Services after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of St.Gallen, Switzerland. Mandatory consumer protection provisions of your country of residence remain unaffected.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely achieves the intended economic effect.
